Welcome to Empowered Unlimited. These Terms of Service govern your use of our website and the purchase and use of our services. By booking a consultation, purchasing a package, submitting payment, or using our services, you agree to these Terms.
1. Services
Empowered Unlimited provides creative and digital business services, including:
- Branding and brand development
- Shopify website design and setup
- E-commerce setup and support
- TikTok Shop setup assistance
- Product and service descriptions
- Website copy and content assistance
- Business launch support
- Other related creative and digital services
The specific services included in your project are determined by the package or service purchased.
2. Shopify Website Services
Empowered Unlimited currently provides website design and setup services exclusively through Shopify.
Clients are responsible for all Shopify subscription fees, domain registration fees, premium themes, paid applications, transaction fees, and other third-party expenses unless specifically stated as included in writing.
Empowered Unlimited is not affiliated with Shopify and is not responsible for Shopify outages, platform changes, account restrictions, pricing changes, technical issues, or other matters controlled by Shopify or third-party providers.
3. TikTok Shop Assistance
Certain packages may include TikTok Shop setup assistance.
Empowered Unlimited can assist with account setup, application preparation, product information, listings, and other setup-related tasks included in the purchased package.
TikTok determines all account, seller, and product eligibility and approvals. Empowered Unlimited cannot guarantee TikTok Shop approval or continued account eligibility.
Clients are responsible for ensuring that their business and products comply with TikTok's requirements and applicable laws.
4. Payments
Payment terms and pricing will be displayed at the time of booking or purchase.
Work will not begin until any required initial payment has been received.
Clients are responsible for third-party costs associated with their project unless otherwise agreed in writing.
5. Consultations & Appointments
Clients should provide at least 24 hours' notice when requesting to cancel or reschedule a consultation.
Missed appointments and late cancellations may be considered used and may require an additional fee to reschedule.
6. Client Responsibilities
Clients are responsible for providing accurate and timely information needed to complete their project.
This may include:
- Business information
- Product or service details
- Images and photographs
- Pricing
- Contact information
- Shipping information
- Business policies
- Login or account access when necessary
- Branding preferences
- Required licenses or documentation
- Feedback and approvals
Project timelines may be extended when requested information, materials, feedback, or approvals are delayed.
7. Client-Provided Materials
Clients are responsible for ensuring they have the legal right to use any photographs, logos, trademarks, videos, written content, product information, graphics, or other materials provided to Empowered Unlimited.
Empowered Unlimited is not responsible for copyright, trademark, licensing, or other claims arising from materials supplied or specifically requested by the client.
8. Revisions
Each package includes only the number of revision rounds specified in the package description or project agreement.
A revision means a reasonable change to work already created based on the original project direction.
Major changes in concept, additional pages, additional products, new features, new branding directions, or work outside the original project scope may require an additional fee.
9. Website Updates After Completion
Once a website has been reviewed, approved, and considered complete, additional changes are not included in the original package unless specifically stated otherwise.
If an update is required to correct an error made by Empowered Unlimited as part of the original project, that correction will not be treated as a paid website update.
Website update pricing may change in the future.
10. Project Approval
Clients are responsible for reviewing their website, branding, written content, product information, links, pricing, policies, and other deliverables before final approval or launch.
Once a client approves a project, requested changes may be considered additional work and may result in additional charges.
11. Project Timelines
Estimated completion dates are provided as estimates and are not guarantees.
Project timelines may be affected by project complexity, revision requests, client response times, third-party platforms, technical issues, or circumstances outside the reasonable control of Empowered Unlimited.
We will make reasonable efforts to communicate significant delays.
12. Refunds & Cancellations
Because our services involve consultations, reserved time, planning, research, customized design, website development, and other personalized work, payments are generally non-refundable once work has begun.
Refund eligibility is governed by the Empowered Unlimited Refund Policy and applicable law.
13. Intellectual Property
Upon full payment, clients may use final custom deliverables created specifically for their business as intended.
Empowered Unlimited retains ownership of its own business name, branding, processes, templates, methods, educational materials, designs not selected as final deliverables, and other pre-existing intellectual property.
Empowered Unlimited materials may not be copied, resold, redistributed, or represented as another person's original work without permission.
14. Portfolio Use
Unless otherwise agreed in writing, Empowered Unlimited may display completed public-facing work in its portfolio, website, or promotional materials as examples of services provided.
Confidential or private client information will not intentionally be disclosed for portfolio purposes.
Clients may request in writing that their project not be featured.
15. No Guarantee of Business Results
Empowered Unlimited provides creative services, business support, and digital tools designed to help clients establish and improve their professional presence.
We do not guarantee specific sales, revenue, customers, website traffic, search-engine rankings, TikTok Shop approval, followers, business growth, or financial results.
Results depend on many factors outside our control.
16. Third-Party Platforms
Empowered Unlimited may assist clients with third-party services such as Shopify, TikTok, domain providers, email providers, apps, payment processors, and other business platforms.
We are not responsible for changes, outages, fees, suspensions, closures, policy changes, security incidents, or decisions made by these third parties.
17. Account Security
Clients remain responsible for their accounts, passwords, payment information, and account security.
When temporary account access is required to complete a service, clients should use secure methods for providing access and change or remove access when the project is complete.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Empowered Unlimited will not be liable for indirect, incidental, special, consequential, or similar damages resulting from the use of our website or services.
Nothing in these Terms limits any rights or remedies that cannot legally be limited under applicable law.
19. Respectful Conduct
Empowered Unlimited reserves the right to discontinue services when a client engages in threatening, abusive, discriminatory, fraudulent, illegal, or seriously inappropriate conduct.
Any refund eligibility in such circumstances will be determined according to work already completed, these Terms, the Refund Policy, and applicable law.
20. Changes to These Terms
Empowered Unlimited may update these Terms of Service periodically as our services and business evolve.
The current version will be posted on our website with the applicable effective date.
21. Governing Law
These Terms of Service are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
